About LC3 Services and Tools

1. LC3 can also help me with my product commercialization within the Country?

Yes, LC3 can present your portfolio of products to some local distributors and resellers in order to perform an assessment in regards to the interest for your products commercialization within the local market. LC3 is a service provider and do not directly commercialize products within the Brazilian market.

2. Can LC3 not just manage the certification projects, but also can control the renewal date, EAN and Anatel codes, and as well generate official labels?

Yes, this is a very important service for all the companies in order to avoid impacts in the commercialization of their products generated by not having valid certificates. 3. Who can use and how does this LC3 Anatel projects management tool work?

4. Can LC3 translate documents in all languages of the world?

About Anatel Certification and Homologation Process

1. Who are the agents who act in the certification process?

Anatel Radiofrequency and Fiscalization Superintendency, OCDs (Designated Certification Organizations) and the Test Laboratories

2. What is an OCD?

OCD stands for Designated Certification Organizations: Organizations that are designated by Anatel, accredited or not, that are considered capable to implement and conduct a compliance assessment process, within telecommunications area, and it is also capable for the issuance of the Compliance Certificate

3. What is a Technical Compliance Certificate?

A Technical Compliance Certificate is a document issued by the OCDs in accordance with the certification system rules, indicating that there is an adequate level of trust about the product, appropriately identified, and in compliance with the regulation issued or adopted by Anatel.

4. What is an Accredited Laboratory and which ones are they?

An Accredited Laboratory is an organization accredited by Inmetro, within the telecommunications area, capable to perform the required tests for the compliance assessment process and also to issue reports, in accordance with the terms of the regulations, procedures and norms for the certification and current standards.

5. Must the certification test be performed only in the accredited laboratories?

Yes, however in the case they can not comply with the requirement of performing the tests within accredited laboratories, the interested party can use other laboratories, if they can perform the tests in accordance with the priority order as follows:

Accredited Laboratories,

Not accredited, third party laboratories,

Not accredited laboratories,

Test laboratories located abroad, but accredited by the official accredited organization of its country of origin, understanding that as a member of the ILAC organization.

6. Can I use test reports performed abroad?

Yes, in very specific cases when capable laboratories don’t exist in some locations for the execution of all the required tests or if the necessary infra structure to be offered by the interested party is not enough for the the tests process. However this is a very complex subject and must be analysed in a case by case situation within an OCD.

7. Who can initiate the ANATEL homologation process?

The following parties are considered legitimate to request, within Anatel, the homologation of their products, in the interested and responsible party condition: The product manufacturer, the supplyer of the product in Brazil and the individual or legal entity who are requesting the telecommunication product for their own use, or not for the market.

8. Can foreign Companies homologate products in Brazil?

Yes, the foreign legal entities, interested in the homologation of products, must have a commercial representative, regularly constituted in Brazil, capable to bear all the responsibilities resulted from the commercialization of the product and able to provide appropriate assistance to the product user in the country. This representative will also be responsible for the quality, supply and technical assistance related to the product within the national territory.

9. Can the Anatel Homologation Certificate be used by third parties?

Yes, in most cases. It will only not be used by third parties in the following situations:

I - a product produced in a manufacturing plant different from the analysed one, in the hypothesis of a Compliance Certificate with a Quality System assessement.

II - If the product is distributed in Brazil by a supplyer different from the one who requested the homologation and that this fact can harm the responsibility in regards of quality, supply and technical assistance related to the product within national territory.

10. Can I change the homologation certificate holder information?

It is allowed to transfer the homologated products to third parties if they are presented along with the fiscal original documentation, in this case, all the rights and obligations related to the compliance assessment and to the homologation are transferred by succession.

11. How does the ANATEL inspection work?

To make sure the homologation process was performed in accordance with all the requirements defined by law, ANATEL can, at its own discretion, request the product or equipment field test performance, in a way that will make it possible to obtain the subsides for the decision making in regards to the opportunity or to the certification viability. Any changes to the project or in the process of manufacturing obligate the responsible party to inform to the Certification Organization who then will evaluate the impact of the changes, deciding about the need to perform new tests or not.

12. Can the requester continue to commercialize a product which the certificate is “suspended”?

In the case of suspension or cancelation of the homologation, the reponsible party for the product is obligated to cease the Anatel brand use, immediately after the publication of the cancelation and suspension acts, such as the commercialization of the product and all and any publicity in that regards.

The lawbreakers will be subject individually or cumulativaly to the following punishment: Warning, fine, homologation suspension, homologation cancelation, designation suspension, designation cancelation. For the commercialization of the non homologated products, within the country, when those products become susceptible of homologation, the punishment for that is a fine and necessary arrangements for the apprehension.

For the punishments enforcement, it will be considered the nature and the seriousness of the infrigement , the damages resulted from it for the services, for the users or for the supplyers and service providers, the economic situation, the advantage earned by the lawbreaker, the reconviction and the aggravating circumstances.

The equipment shall be sealed whenever it is not possible to enforce their aprehension. The fine to be applied individually for not complying with any of the regulation terms, cannot be less than R$100,00 (one hundred reais), neither that can be above R$3.000.000,00 (three million reais).

13. After how much time the suspended certificate can automatically be canceled?

After 180 (one hundred and eighty) days from the suspension date, without a new certification, or yet without presenting a justification accepted by the Designated Certification Organization, the Compliance Certificate will be subjected to a cancelation.

14. There is no space in my product to glue the Anatel homologation label. Is there an alternative for this case?

When there is no space for attaching the brand mark and homologation indentification code in the product, it must be provided a stamp, an homologation identification code and the operation manual bar code identification for the user and, optionally, in the product ´s packing. It is good to mention that for this matter, the interested party must request a written permition from Anatel to execute such procedure.

15. What are the Anatel´s fees?

Compliance Certificate Homologation = R$ 500,00

Compliance Declaration Homologation = R$ 200,00

Homologation Renewal = R$ 200,00

16. What does ILAC stand for?

ILAC means “International Laboratories Accreditation Cooperation” and refers to the international forum which has the objective to support the accreditation responsible organizations in regards to their laboratory tests and calibration, granting them the criteria and procedures which can assure the confiability of their services results.

17. What is a Mutual Recognition Agreement and what is that for?

The ARM is an agreement settled between countries with the purpose of simplifying the telecommunication products compliance assessment procedures and, this way, to facilitate the commercialization of products within the parties. It is for the involved parties aknowledgement in regards to the Certification Organizations and to the mutual acceptance of the activities developed for the compliance assessment, in accordance with the importers parties regulations.
